Terms of Service

1. Agreement to Terms

By engaging the services of Apex Iguana Control LLC ("Company," "we," "our"), whether through a signed Master Service Agreement, verbal authorization, or any other form of service request, you ("Client," "you") agree to the following Terms of Service. These terms govern all service engagements between Apex Iguana Control LLC and its clients.

These Terms of Service apply to all residential, waterfront, HOA, golf course, and commercial service engagements, including one-time services and ongoing subscription plans.

2. Service Disclaimer

Apex Iguana Control LLC provides professional invasive iguana population management and wildlife control services. All services are performed in compliance with Florida Fish and Wildlife Conservation Commission (FWC) regulations and Florida Department of Agriculture and Consumer Services (FDACS) guidelines.

Services are rendered on a best-effort basis. Apex Iguana Control LLC does not represent itself as an exterminator, licensed pest control operator, or general wildlife removal service. Our services are specific to invasive iguana population management and any additional species for which we hold written FWC authorization.

The Client acknowledges that wildlife management involves inherent variability and that outcomes may differ based on property characteristics, surrounding environment, iguana population density, and seasonal behavior patterns.

3. No Guarantee of Complete Wildlife Removal

Apex Iguana Control LLC makes no guarantee of complete, total, or permanent removal of iguanas or any other wildlife species from Client property.

South Florida's green iguana population is regional in nature. Iguanas removed from a property may be replaced by new individuals migrating from adjacent areas, canals, greenbelts, or neighboring properties. Effective management requires ongoing population suppression, not a single intervention.

Our subscription service model is specifically designed to address this reality through consistent, recurring visits that progressively suppress local populations over time. One-time removals do not carry any expectation of lasting results.

The Client agrees that Apex Iguana Control LLC shall not be held liable for the re-appearance of iguanas or other wildlife on Client property following any service visit.

4. Property Access

The Client grants Apex Iguana Control LLC and its authorized technicians permission to access the Client's property for the purpose of performing scheduled and authorized services. This includes access to:

The Client is responsible for ensuring unobstructed access to the property at the time of scheduled service visits. If access is blocked or denied, the service visit will be logged as completed and billed accordingly unless the Client provides at least 24 hours' prior notice of access restriction.

The Client warrants that they have the legal authority to grant access to the property and that no third-party permissions are required beyond those the Client can provide.

5. Limitation of Liability

To the fullest extent permitted by applicable Florida law, Apex Iguana Control LLC's total liability to the Client for any claim arising from or related to services rendered shall not exceed the total fees paid by the Client in the thirty (30) days preceding the date on which the claim arises.

The Client acknowledges that all services are performed with reasonable professional care and in compliance with applicable regulations, and that the limitation of liability reflects a fair allocation of risk between the parties.

6. Payment Terms

All subscription services are billed on a monthly cycle. By enrolling in a subscription plan, the Client authorizes Apex Iguana Control LLC to collect the applicable monthly service fee on a recurring basis.

Pricing is subject to change with 30 days' written notice to the Client. Continued use of services after the notice period constitutes acceptance of the updated pricing.

7. Cancellation Policy

Clients enrolled in subscription plans may cancel service by providing written notice to Apex Iguana Control LLC at Apexiguanacontrol@gmail.com or by written correspondence to our business address.

Cancellation terms:

Apex Iguana Control LLC reserves the right to terminate service at any time for non-payment, breach of these terms, or denial of property access. In the event of Company-initiated termination for reasons other than Client breach, a prorated refund for prepaid but unrendered services will be issued.

8. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Florida. Any disputes arising under or related to these terms shall be resolved in the courts of Palm Beach County, Florida, and both parties consent to the exclusive jurisdiction of such courts.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
